Terms and conditions of sale
1. Natural variation
All natural materials (granite, marble and natural stone) supplied are subject to their natural markings, veining, variations in color, cracks and vents, with the polished surface subject to slight imperfections. These are supplied cramped, stopped or reinforced where necessary and no claim on this account can be made.
2. Color
Some materials with high levels of veining may appear darker or lighter dependant on lighting and the angle at which the granite is viewed.
3. Descriptions
Any description of materials offered are guidance only and do not imply suitability for any particular purpose. It is hereby agreed that the Buyer may be exposed to additional charges by Dea Marble for sanding, polishing, filing, honing, and/or grinding marble and granite surfaces in accordance with the Buyer’s requests following installation. In addition, Dea Marble will not be responsible for the removal and/or installation of electrical outlets, related electrical parts, plumbing, or any mechanical services, that may in any way effect the installation and/or removal of solid surfaces or related products. Before the installers come the premises must be free from any obstacles.
4. Samples
Dea Marble does not hold specific slabs and the changing inventory may be replaced by a new stock prior to a job being fabricated. Granite colors can vary from one shipment to the next, and it is suggested that the current inventory be viewed. Dea Marble will not prompt contact based on receipt of new inventory. It is the responsibility of the customer to maintain contact with Dea Marble to re-view granite one to two weeks prior to cabinet installation. I understand that re-selection may only be considered prior to templating. When samples have been submitted exact resemblance of the product supplied to the sample cannot be guaranteed.
5. Jointing
There is a limitation to the overall slab sizes available. Seam placement is determined by Dea Marble once templates have been made. The size of granite slab available, project templates and appliance configurations are all items that determine seam location, if any. I am aware that seams can not be hidden and will be visible. Patterns may not match at seams. Unless otherwise specified jointing will be at our discretion to suit material and practical handling.
6. Liabilty
The Buyer hereby acknowledges that all products offered by Dea Marble are subject to substantial variations in color, shading, width, dimensions, texture, shape, finish, consistency and durability.It is understood and agreed that Dea Marble shall not be held responsible for any and all damages and/or claims resulting from natural variations in the products or modifications during installation as a result thereof. Likewise, Dea Marble shall not be responsible for discretionary decisions concerning the installation and placement of materials including but not limited to solid surfaces, tiles, inserts, baseboards, and grout made by Dea Marble and/or its sub-contractors and/or employees during installation. Stone products, due to their brittle and porous nature, are subject to chipping and splitting and Dea Marble shall not be responsible for such events. Dea marble excludes defects or damages caused by the following: Customer abuse or misuse of the surface and failure to maintain stone properly, in accordance with Dea Marble Company’s recommendations given to each customer after completion of the job. Stains and/or discoloration, dark spots or fissures which are naturally occurring in the stone. Normal spotting or discoloration caused by leaving acidic liquid spills on the surface which can be removed by fine gain steel wool and a stone cleaning compound. Also scratches to stone surfaces caused by sharp instruments. No representations, warranties or conditions are given as to the fitness of the material for any purpose or use which the purchaser intends for the goods supplied.
7. Payment
10% down-payment is required at the time an order is placed, 40% of the total estimated order due at time of templating and final payment due upon installation paid with cash or certified cheques or funds.
The sole property in the goods shall not pass to the Customer until Dea Marble Ltd has received full cleared payment. Dea Marble Ltd reserve the right to, with no notice, attend the customer’s or the customer’s customer’s premises, to collect any items, that remain unpaid, after the due date has passed. Customers, upon receipt of our goods, may not sell our goods on, until Dea Marble Ltd has been paid in full. This is our retention of title, and the customer agrees to give us a walking possession agreement to collect such goods.
